Hikvision Transparency Report: 
Protocol for Handling Government Information Requests

As a leading global AIoT solution provider committed to leveraging technology for good, Hikvision Digital Technology Co., Ltd., along with its domestic and foreign wholly-owned subsidiaries, holding subsidiaries, and branches (collectively "Hikvision," "Company," "we," "our," or "us") prioritizes the information security and privacy of our customers. When delivering comprehensive security solutions, we maintain a strict policy: without explicit prior authorization from customers, Hikvision does not access any video content generated through the use of our products and platforms.

 

We cooperate with government agencies only when they submit formal requests in accordance with applicable laws and regulations. Upon receiving such requests, we conduct a thorough review to determine if and how we can appropriately respond. Only after this assessment will we process user information strictly within the bounds permitted by applicable law.

 

Hikvision maintains the highest standards of transparency and implements robust data security measures to protect our customers' information.

 

Hikvision has never implemented any "backdoor" or "master key" in our products or services. We have never permitted any government entity direct access to Hikvision servers, and we will never do so in the future.

When Government Requests Are Received

While maintaining these strict security standards, Hikvision occasionally receives formal information requests from government authorities. The following section outlines how we handle these requests and the processes we follow to protect user privacy.

Types of Government Requests Received by HIKVISION

Hikvision may receive various legal requests seeking information or specific actions within the boundaries of administrative, judicial, or law enforcement requirements. These requests originate from government agencies in countries and regions where we provide products and services.

 

Common Request Scenarios

Government requests typically fall into the following categories:

 

  1. Criminal Investigation Support: When surveillance footage contains potential evidence of criminal activity requiring verification, investigative agencies may request technical assistance to identify product owners/users, obtain account information, retrieve usage records, or access usage data.
  2. User Protection Measures: When a user's product is stolen, data is compromised, or systems are hacked, relevant authorities may act on the user's behalf to request IP login information or account deactivation.
  3. Civil Dispute Resolution: In civil litigation, courts and related institutions may request order records or after-sales information from user accounts at the behest of plaintiffs or defendants.
  4. Public Safety Emergencies: During situations that threaten public safety, administrative or law enforcement agencies may require our cooperation in accordance with applicable laws and regulations.

 

Legal Request Formats

Common legal requests we receive include:

 

  • Legally valid subpoenas
  • Search warrants
  • Requisition or Judicial Rogatory Letters (France)
  • Solicitud Datos (Spain)
  • Auskunftsersuchen (Germany)
  • Obligation de dépôt (Switzerland)
  • Personal Data Request (UK)

Types of Information HIKVISION will Provide

Information Categories Available for Disclosure

The customer information collected by Hikvision falls into two distinct categories:

 

Non-Content Information

This category includes customer account registration details such as:

 

  • Company name or personal name
  • Legal representative information (where applicable)
  • Contact information (email and telephone)
  • Basic details of Hikvision hardware products deployed by customers (product serial number, model)
  • Purchase records for products or services ordered directly from Hikvision
  • Timestamped data, including alarm event logs and access control usage times

 

Note: Non-media data, such as timestamped logs of alarm events or access control usage times are classified as product usage logs and fall under Non-Content Information.

 

Content Information

This category primarily consists of media data generated through product usage:

 

  • Audio and video recordings
  • Visual records from access control systems
  • Other media content transmitted, recorded, or stored when using Hikvision software and hardware

 

 

Hikvision does not have access to any video or audio data that is collected by end users through their Hikvision products. Only with explicit prior consent from end users AND when legal requirements are met can Hikvision access limited data, which is strictly confined to "Non-Content Information" as defined above. We never access Content Information under any circumstances, and therefore cannot disclose such information to government agencies, regardless of the request.

 

The types of information Hikvision can access and potentially support government requests for are as follows:

 

A. User Account Identity Information: Registered username (personal or company name), mobile phone number or email address, registration time, region information, corporate certification information, representative information, and other background information provided when users register on Hikvision platforms.

 

B. Product Binding Information: Hikvision product information bound to user accounts, including product name, model, serial number, binding time, and product sharing status.

 

C. Usage Information: Login and operation logs, including user account login time, IP address, terminal device information (mobile phone model, client version number), and device operation logs (online and offline records).

 

D. Shopping or Transaction Records: Order information (time, goods, amount, payment method), purchase or order records, and delivery address (if applicable) when customers use the Hikvision B2B platform and cloud service to purchase services.

 

E. Other Information: Questionnaires, ratings, problem feedback submitted by customers, after-sales service records, etc.

 

Content Information (Never Accessible)

Important Note

This category of data is never accessible to Hikvision and includes:

  • Audio and video recordings
  • Visual records from access control systems
  • Other media content transmitted, recorded, or stored on end users' Hikvision devices

Procedures for Handling Government Requests

1. Request Submission Requirements

Government requests must be submitted through official channels and must include:

  • Delivery from an official government agency address
  • Valid legal authorization certificates
  • Submission via registered mail to Hikvision's registered office in the relevant country/region

Request Requirements for Expedited Processing

For efficient processing, all government requests must:

  • Clearly cite the specific legal basis (laws and regulations) supporting the request
  • Comply fully with all applicable laws and regulations, including but not limited to the EU General Data Protection Regulation (GDPR) and EU Digital Services Act
  • Follow the standardized format outlined below

 

Hikvision reserves the right to charge reasonable processing fees to government agencies for the resources expended in fulfilling lawful requests.

2. How HIKVISION Manages Various Types of Requests

Hikvision maintains a centralized and standardized process for receiving, tracking, processing, and responding to legal requests from government agencies.

 

When processing requests, Hikvision requires all government agencies to comply with applicable laws and regulations. We also contractually require our service providers to adhere to these same standards. Our legal team thoroughly reviews all incoming requests to ensure they have a valid legal basis. If we determine that a request lacks legitimate grounds, is unclear, overly broad, or may harm the legitimate interests of any third party, Hikvision reserves the right to object to, question, or reject such a request.

 

Emergency Requests

Hikvision will expedite requests deemed emergency in nature, specifically those involving urgent and serious threats to:

  • Personal life or security
  • National security
  • Critical infrastructure or installations

 

Such expedited processing will only occur when the requesting government agency provides sufficient evidence that its request involves one of these emergency situations.

 

Account Restriction or Deletion Requests

When a government agency requests that Hikvision restrict or delete a customer or user account, we require:

  • A valid court order or equivalent legal instrument (such as an injunction, conviction verdict, or writ)
  • Clear evidence that the account was used illegally or infringed on others' legitimate rights

 

If the request lacks valid legal basis or the agency cannot demonstrate illegal use or rights infringement, Hikvision will deny or challenge the request.

 

Upon receipt of a qualified legal order that sufficiently proves illegal account usage or rights infringement, Hikvision will:

  1. Take the necessary steps to restrict or delete the account as required
  2. Inform the requesting agency of actions taken

 

Cross-Border Data Requests

As an international corporation, Hikvision acknowledges its heightened responsibility regarding data protection across jurisdictions. We apply additional scrutiny to cross-border data requests, which occur when a public authority in one country requests that a local Hikvision entity provide customer personal data stored in another country. All such requests are processed strictly in accordance with applicable international laws, data transfer regulations, and relevant jurisdictional requirements.

 

Customer Notification Policy

When Hikvision provides customer or user account information in response to legitimate government requests, we notify the affected individuals as soon as possible, except when:

  • A court order or applicable law explicitly prohibits notification
  • Hikvision reasonably believes the notification could pose a risk of injury or death to an identifiable individual
  • The case involves child abuse or exploitation
  • The notification would be irrelevant to the fundamental facts of the case

 

Delayed Notification for Emergency Disclosures

For emergency information disclosures, Hikvision will provide delayed notification to affected customers or users after 30 days, except when:

  • Notification is prohibited by court order or applicable law
  • Hikvision reasonably believes notification could endanger identifiable individuals or groups
  • The case involves child abuse or exploitation

 

Confidentiality Orders

When Hikvision receives a court order with a specified confidentiality period, we will provide notification to affected customers or users only after the confidentiality period expires, except when:

  • Notification could pose a risk of harm or death to identifiable individuals or groups
  • The case involves child abuse or exploitation
  • The notification would be irrelevant to the fundamental facts of the case

 

Account Restriction or Deletion Notifications

When Hikvision restricts or deletes an account based on a valid court order (such as a guilty verdict or writ) that proves illegal use or rights infringement, we will notify the affected customer or user, except when:

  • The legal proceeding itself, a court order, or applicable law prohibits notification
  • The case involves child abuse or exploitation
  • Hikvision has reasonable grounds to believe the notification could endanger identifiable individuals or groups
  • Notification would be irrelevant to the underlying facts of the case

How HIKVISION Counts and Reports  Government Requests

Transparency Reporting Schedule

Beginning February 2024, Hikvision will publish an annual transparency report on our official website (https://www.hikvision.com/en/). This report will disclose the types and quantities of government requests received during the previous calendar year, along with the countries and regions from which these requests originated.

 

Request Counting Methodology

For reporting purposes, Hikvision counts government requests using the following principles:

  • Each request processed under the same valid legal basis counts as one request
  • Challenged or denied requests are included in our reporting metrics
  • Revised requests are counted as new, separate requests
  • Multiple information requests about a single product or account in one legal document count as one request

 

Request Classification

Hikvision categorizes government requests into the following types:

  1. Product requests
  2. Account requests
  3. Transaction-related requests
  4. Emergency investigation requests

 

Current Disclosure Scope

Our transparency reporting covers government requests related to all Hikvision products and services, including but not limited to:

  • Security cameras and video surveillance equipment
  • Network Video Recorders (NVRs) and Digital Video Recorders (DVRs)
  • Video management software and platforms
  • Access control systems
  • Intercom and alarm systems
  • Platforms including Hik-Partner Pro, HikCentral Connect, and Hik-Connect
  • Other Hikvision hardware, software, and services

 

Reporting Categories

Government requests are reported in the following categories:

  1. Worldwide Government Product Requests
  2. Worldwide Government Account Requests
  3. Worldwide Government Transaction Information Requests
  4. Worldwide Government Emergency Requests

 

Hikvision will expand these categories as needed in future transparency reports to include any additional legitimate request types we may receive.

Number of Products Specified in Requests

This reflects the total number of products identified across all requests. A single request may contain multiple product identifiers (for example, in cases involving theft of multiple items, where law enforcement seeks information on several products in one request). The total count is reported by country/region.

 

Number of Product-based Requests Where Data Provided

This indicates how many product-based requests resulted in Hikvision providing data in response to valid legal requests. Data may include customer associations, product connections to Hikvision services, purchase information, customer service records, or repair history. The total is reported by country or region.

 

Percentage of Product-based Requests Where Data Provided

This percentage represents the proportion of product-based requests that resulted in data disclosure. It is calculated by dividing the number of requests where data was provided by the total number of product-based requests received for each country or region.

This table provides information about account-based requests received from government authorities. These typically occur when law enforcement agencies investigate suspected unlawful use of Hikvision accounts. Account-based requests generally seek details about such as Hik-Partner Pro accounts or Hik-Connect accounts, including associated phone numbers or IP addresses.

This indicates how many account-based requests resulted in Hikvision providing non-content data in response to valid legal requests. Non-content data may include registration information, login logs, bound products, or transactional information. The total is reported by country or region.

This percentage represents the proportion of account-based requests that resulted in non-content data disclosure. It is calculated by dividing the number of requests where non-content data was provided by the total number of account-based requests received for each country or region.

This table provides information about emergency requests received from government agencies. Under applicable laws and regulations, government entities may request Hikvision to voluntarily disclose information when there is an imminent danger of death or serious physical injury requiring immediate action. Examples include missing persons cases where law enforcement believes the individual may be in danger. Emergency requests typically seek information about customers' connections to and use of Hikvision services.
