The following constitute the terms and conditions to which applicants agree when booking any HIKVISION e-learning Content (“Terms”). Hangzhou Hikvision Digital Technology Co., Ltd and its affiliates ("HIKVISION", "we", "our", "us") provide courses, learning materials, quizzes, exams, certifications and training programs, etc. ("Content", "Contents") for use in conjunction with various HIKVISION products/solutions through all services that may be accessed at https://elearning.hikvision.com/, and all associated sites connected with https://elearning.hikvision.com/, excluding any third parties' sites (“Website”, "Websites").
YOU AGREE THAT, IF YOU ARE LOCATED IN GERMANY, SWITZERLAND, OR AUSTRIA, THE TERMS ARE BETWEEN YOU AND HIKVISION EUROPE B.V.; IF YOU ARE LOCATED IN POLAND, THE TERMS ARE BETWEEN YOU AND HIKVISION POLAND SPÓŁKA Z OGRANICZONA ODPOWIEDZIALNOSCIA.
YOU MAY NOT ORDER OR OBTAIN CONTENT FROM US IF YOU (A) DO NOT AGREE TO THESE TERMS, (B) ARE NOT THE OLDER OF (I) AT LEAST 18 YEARS OF AGE OR (II) LEGAL AGE TO FORM A BINDING CONTRACT WITH US, (C) ARE PROHIBITED FROM ACCESSING OR USING THE WEBSITE BY APPLICABLE LAW, OR (D) YOU ARE NOT AUTHORISED BY YOUR ORGANISTATION TO SUBSCRIBE TO OUR CHARGEABLE CONTENT IF YOU REGISTERED THE ACCOUNT ON BEHALF OF YOUR ORGANISATION.
By clicking the selection box and clicking the“Place Order”button on Website via your OneHikID Account, you agree to comply with these Payment Terms & Conditions, as well as our Terms of Service, Privacy Policy and all applicable laws.
1. BOOKING
1.1 Instructor-Led Training Course ("Course", "Courses") can be booked via the course details page available on the Website. When you submit a booking for a Course, your submission and succeed payment represents an offer to HIKVISION to book you onto the Course you selected. You will receive an automated summary email of your selection after the payment is done.
1.2 Prices, currencies, taxes, and fees are pre-configured based on your geographic location and are visible before checkout. Our chargeable Course will not be accessible to you until you pay the applicable Course fees associated with that subscription.
2. PAYMENT
2.1 You may view our current subscription fees for chargeable Course on the corresponding pages of the Website. You also understand that the actual fees shall be subject to the actual payment page.
2.2 Course fees can be paid via direct bank transfer or third-party payment platform. Available payment methods may vary depending on region and will be displayed as options during checkout.
2.3 If you are located in Poland, you must wait for HIKVISION administrator approval after booking. Once approved, you will receive an email notification to return to the eLearning platform and complete the payment.
2.4 If you choose to pay by bank transfer, the payment must be made directly to our designated bank account, manual confirmation and approval are required.
2.5 If you choose to pay by the third-party payment platform, you will be redirected to a third-party payment service provider for immediate payment after placing the order.
2.6 Please note that the third-party payment service provider is solely responsible for its services, including security and stability. You are advised to review the third-party payment service provider’s terms of service and privacy policy. HIKVISION disclaims all liability related to the third-party payment service provider’s services. Except for payment amount, results and records, HIKVISION will not collect or store your bank details, including bank accounts number and other financial information.
2.7 Course fees vary by region and currency. Taxes (VAT, TVA etc.), if any, are charged at the applicable rate depending on the Course and/or you.
3. YOUR OBLIGATIONS
3.1 You may not allow anyone else to access the Course via your log-in details. You must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which the training Courses are provided. HIKVISION reserves the right to remove any delegate from a training course whose behavior is deemed inappropriate by HIKVISION or its trainers. In these circumstances, HIKVISION will neither refund any fees nor reimburse any other costs.
4. RESCHEDULING, NON-CANCELLATION, AND NON-REFUND
4.1 Course registrations cannot be cancelled or transferred to third parties.
4.2 If you withdraw for any reason before the start date of a Course, no refund will be issued but you may reschedule your place on the course to another time slot agreed by HIKVISION. Rescheduling should be notified to HIKVISION at least 7 business days prior to the Course start date. If you fail to attend the Course on which you are booked without giving prior notice to HIKVISION, we are unable to refund the Course fees or offer a rescheduling.
4.3 You must make any request to reschedule a Course in writing, which may be sent by email to: eLearninglobal@hikvision.com.
4.4 Please also note that we treat violations of our Terms of Use very seriously, and we have no obligation to offer refunds to users who violate these or other Hikvision policies. Similarly, we have no obligation to offer late refunds to Users who do not receive a passing mark in a Course, or who are otherwise unsatisfied with their final grade or the Course.
4.5 EU USERS WITHDRAWAL RIGHT
a) European Users purchasing digital training services via distance communication have the right to withdraw from the contract within 14 calendar days without giving any reason. The withdrawal period shall start from the date of payment confirmation and expire if you explicitly consent to Course commencement during the withdrawal period and acknowledge loss of withdrawal right upon full performance.
b) No withdrawal right applies if:
(i) You accessed/downloaded Course materials during the withdrawal period;
(ii) Course were fully performed before the withdrawal notice;
(iii) Course contains personalized/customized content.
c) To exercise the right of withdrawal, you should inform us of your decision to withdraw by submitting a clear written notice via email eLearningglobal@hikvision.com before the withdrawal period expiry.
d) If you withdraw the Course, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed of your detailed decision to rescind this contract in accordance with this Terms. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.
e) If you exercise the right of withdrawal before the Course has been fully performed, you shall be liable to pay us reasonable costs, consisting of an amount which is in proportion to what has been provided until the time you have informed us of the exercise of the right of withdrawal.
f) The burden of proof of exercising the right of withdrawal in accordance with this clause shall be on you. Except as provided for in this clause, you shall not incur any liability as a consequence of the exercise of the right of withdrawal.
5. INVOICE
5.1 Upon successful payment completion, an electronic invoice will be automatically generated and accessble at the post-payment page, as well as in your account’s “Order History” section. Modifications to invoice Course will not be processed after issuance.
6. THIRD-PARTY PAYMENT DATA SHARING
6.1 To facilitate payment processing, HIKVISION will share necessary user information (including account name, contact details, billing address, and transaction-related data) with authorized third-party payment service providers. These third parties are contractually obligated to:
a) Process data solely for executing payment transactions under this Terms;
b) Implement industry-standard security measures to protect your information;
c) Retain data only as required by applicable laws or operational needs.

7. LIMITATION OF LIABILITY
7.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIKVISION SHALL NOT BE LIABLE FOR ANY LOSS OF USE, LOST OR INACCURATE DATA, FAILURE OF SECURITY MECHANISMS, INTERRUPTION OF BUSINESS, COSTS OF DELAY OR ANY INDIRECT, SPECIAL, INCIDENTAL, RELIANCE OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS), REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) STRICT LIABILITY OR OTHERWISE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIKVISION'S AGGREGATE LIABILITY TO THE OTHER SHALL EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO HIKVISION FOR THE TRAINING GIVING RAISE TO A CLAIM.
8. WARRANTY AND DISCLAIMER
8.1 HIKVISION shall not be liable for any interruptions, failures, or errors in payment processing (including but not limited to delayed/failed transactions, incorrect deductions, or service disruptions) caused by third-party payment service providers. Users are solely responsible for verifying transaction statuses and resolving disputes directly with the relevant payment provider. This exclusion of liability applies to the fullest extent permitted by applicable law.
8.2 HIKVISION does not warrant that the provision of any Course online will always be available or be uninterrupted, timely or error free, that defects will be corrected or that such Course is secure or free from bugs, viruses, errors and omissions.
9. OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS
9.1 All Course is owned by HIKVISION. All intellectual property rights in all Course available, including the design, graphics and text of all printed materials and the audio of all webinars and podcasts, are owned by HIKVISION. When you are given access to the Course, you are granted a non-exclusive, non-transferable, revocable license to use the Course. No Course may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without HIKVISION's prior permission. Any such use is strictly prohibited and will constitute an infringement of HIKVISION's intellectual property rights.
10. FORCE MAJEURE
10.1 We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.
11. MISCELLANEOUS
11.1 Assignment: You will not assign any of your rights or delegate any of your obligations under these Terms without our prior written consent. Any purported assignment or delegation in violation of this Section is null and void. No assignment or delegation relieves you of any of your obligations under these Terms.
11.2 No Waivers: The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of HIKVISION.
11.3 No Third Party Beneficiaries: These Terms do not and are not intended to confer any rights or remedies upon any person other than you.
11.4 Severability: If any provision of these Terms is invalid, illegal, void, or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
11.5 Entire Agreement: This Terms, Terms of Use and Privacy Policy are the entire agreements between you and HIKVISION relating to the eLearning Course all prior or contemporaneous oral or written communications, proposals, and representations with respect to the Course or any other subject matter covered by these policies. If any provision of these policies is held to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect.
