License Agreement of Hikvision Drive Software
Important Notice:
Please read and understand all the rights and limitations stipulated in this License Agreement for using SDK ,Demo，Driver，Client software, and any other documentation and software of Hikvision DS-1000KI Keyboard,DS-100XKI RS485 series Keyboard, DS-400xMDI series Matrix decoding card, DS-40xxHCI/HSI/HCSI series compression card, DS-6000HCI series DVS, DS-6100HCI/HCI-ATA series DVS, DS-6101HFI-IP series DVS, DS-7xxxHI series embedded DVR, DS-8000HCI/HFI/ HTI/ HFI-S/HCI-S series DVR, DS-2CCXXX series Camera (hereinafter referred to as “the Agreement”). You need to check and accept all the clauses of this Agreement. The software or documentation shall not be downloaded and installed on your computer unless you accept the clauses of this Agreement totally.
Once clicking “accept” button, namely, you sign to accept all the clauses of he Agreement.
This Agreement is a legal Agreement about the “software and documentation” between You (individual or single entity) and Hangzhou Hikvision Digital Technology Co., Ltd (hereinafter referred to as “Hikvision”). The software includes enclosed computer “software” (composed of DSP software, driver, system SDK, player SDK, Microsoft media player control, demonstration procedure), and relatively electronic, printed and on-line file. Once installing the software, namely, you agree to accept all of the restriction of this Agreement. Otherwise, please don’t install and utilize this “software”.
Software production license
This" software" is under the protection of <China>>, << Computer software protection regulations >>, international copyright treaties and other intellectual property rights treaties. This “software” is granted for utilization purpose rather than sale purpose.
1.The granting of the License
This Agreement grants the following rights to you:
*Downloading explanation
Without the authorization of Hikvision, you shall not download this software from this website.
*Software
You can install, utilize, access, materialize and operate one copy of the “software” in a single computer where DS-400XM/S,DS-4004D,DS-400XH/HD Series Compression Card produced by Hikvision is pre-installed on condition that you obtain one license for each computer.
*Reservation of rights
All the other rights that are not explicitly granted are possessed by Hikvision without exception.
2.Limitation
1) Limitation of Utilization
You can only operate this “software”, the copy or subassembly of the “software” on the compression card which is produced by Hikvision and sold by Hikvision’s designated distributor. If you attempt to operate this “software” on the compression card which is not produced by Hikvision and not sold by Hikvision’s designated distributor, you shall immediately cease the installation and destroy this “software” and its copy, otherwise, Hikvision reserves the right to investigate and affix the responsibility for violations.
2) Reservation of the Copyright Illustration
You shall not delete or modify the copyright declaration, illustration and version information of all subassembly of this “software production” copies.
3) Lease
You shall not rent out, lease or lend out this “software” production.
4) Transfer of Software
You can transfer all rights under this Agreement permanently on the condition that you keep no copy and transfer all of this “software production” including all of the subassembly, medium and printed materials, any update edition, this Agreement and if available, <>) and, that the transferee accepts all of the terms and conditions of the Agreement. If the “software production” is the update edition, you shall also transfer all the previous editions.
5) Supportive Service
Hikvision might offer support service related to the “software” based on Hikvision’s own discretion. The utilize of supportive service is limited to the users’ manual of supportive service," on-line” file and every policy and plan stated in the other material that Hikvision offers. Any Additional “software” code provided as supportive service to you shall be considered as a part of" software", and every provision equally applies to such “software” codes.
6) Update Edition
Hilkvision keeps the right, by offering upgrading edition of" software" for you, to replace, revise or upgrade this software in any time. The upgrading edition of" software" which Party A offers to Party B shall be considered as a part of" software" and shall be confined by the previsions of the Agreement.
3. Termination
If you don’t abide by any term and condition of this Agreement, Hikvision can terminate this Agreement without prejudice to other rights. If Hikvision terminates this Agreement, you shall cease the utilization of this " software" and destroy all copies of this " software" immediately.
4. Copyright
The property right and copyright of this" software production" (including however not limited to software modules, data files, documents, application programs, source code, images, characters), enclosed printed materials, and any copy of" software production" are possessed by Hikvision. This" software" is under the protection of <China>>, << Computer software protection regulations >>, international copyright treaties and other intellectual property rights treaties.
5. Limited Liability
Within the scope of maximum amounts allowed by the applicable law, under any circumstance, Hikvision shall not bear the liability to compensate any special, accidental, direct or indirect loss (including however not limited to loss of profit, suspension of business transaction, loss of commercial information or any other pecuniary loss) due to utilization of this “software production”, inability to utilize this software production, offer supportive services or inability to offer supportive services, even though Hikvision has been notified the possibility of occurrence of such loss in advance.
6. The Applicable Law
This Agreement, the limited guarantee as well as the limited liability mentioned above apply within the jurisdiction of laws of the People's Republic of China.
